外國銀行欺負台灣人」、「綠色銀行打壓台灣勞工金融怪獸公然違法,

政府單位放縱外商銀行裁撤11家分行,不當解僱勞工,明顯失職監督不周。

公布滙豐銀行公然違法事項並要求立即改善具體措施



    滙豐銀行工會等將於9月15日上午十點,與費鴻泰委員在立法院中興
大樓103會議室召開記者會,公布全球第一大銀行「滙豐銀行」及號稱愛
台灣綠色銀行「陽信銀行」 ,如何違反工會法,打壓勞動人權、欺壓台
灣勞工。 滙豐銀行更違反金管會及中央存保標售契約,在合併中華銀行
短短半年內即預告,將於11月底前裁撤全省計 11 家分行(原中華商銀分
行),相關人員調動達200人以上,並以調動之名行裁員之實,罔顧台灣
勞工的權益!政府機關包括金管會、勞委會、勞工局等單位明顯包庇、
企圖粉飾太平。


      滙豐銀行要求員工不得加入工會,工會表示:分行員工加入工會後
,資方旋即以工作權為誘因,並約談施壓予會員同仁,致使該分行會員
集體退出工會。資方更以內部規範圍為由,對工會幹部使用內部網路傳
遞工會訊息,祭出濫用公司資源以圖個人或他人利益之不當行為警告函
。藉以打擊工會幹部,嚴禁工會與會員同仁間之資訊互動,嚴重侵害台
灣勞工勞動人權。

     而號稱愛台灣、貼近基層、傾聽人民心聲的民進黨,拿陽信銀行員
工做為人頭黨員,以工作權要脅員工,強迫集體投票,選出不分區立委
薛凌。在陽信銀行工會成立後,屢遭資方打壓,單位主管除了用言語恫
嚇加入工會者外,更以任意調動職務手段,強迫任職10多年的工會幹部
調任臨櫃業務,甚至要求工會幹部必須以自己之休假來處理會務。

     爰此兩家銀行已違反工會法第三十五條:「僱主或其代理人,不得
因工人擔任工會職務,拒絕僱用或解僱及為其他不利之待遇」、就業服
務法第五條:「即不得以種族、階級……或以往工會會員身分為由,予
以歧視」及憲法第十四條:「人民有集會及結社之自由」之規定,外商
銀行不尊重工會、恣意妄為,立法委員不能保護人民,甚至帶頭違法,
正代表政府威信的淪喪和對勞工權益的漠視。

      然而更讓人民生活雪上加霜的是,二次金改將體質好的銀行送給財
團,掏空的銀行由全民買單。以中華銀行為例:金融重建基金拿全體納
稅人的錢賠付給外資 474 億元,就是希望外資能重整問題銀行的體質,
引進最新的資訊與管理科技,重新穩步經營,並穩定金融市場的秩序,
不要大舉裁員來造成社會問題。而滙豐銀行卻在併購中華商銀短短半年
內即預告,將於11月底前裁撤全省計11家分行(原中華商銀分行),且
裁撤的分行多位於就業困難的縣市。相關人員異動達 200 多人以上,若
無法配合調動者,須自願申請終止雇用契約且無法發放非自願資遣證明
,藉以規避勞基法第11條之規定。

      另一方面資方此次大規模調動及迫使員工無奈選擇填寫自願申請終
止雇用契約,顯然已違反中央存款保險股份有限公司標售中華商業銀行
股份有限公司公告事項中,有關員工安置計畫承諾基於保障員工權益,
保障聘用期間自概括讓與承受基準日起算不低於一年之規定。此等明顯
違法的舉動,均不見金管會、勞委會、勞工局等國家機關,站出來保護
本國勞工,如此瀆職的行為著實讓人民感到失望。

      台灣政府對從業員工的保障太少,只重視企業經營者的利益,而不
要求他們負擔應有的社會責任,這將是台灣人最大的悲哀與無奈,工會
呼籲台灣政府,應提出具體強勢的作為,要求來台投資的外商銀行,確
實保障台灣勞工的工作權、確保就業安定,避免造成勞工失業問題。落
實真正的「取之於台灣,用之於台灣」!

HSBC Bank Union(滙豐銀行工會)plans to hold press conference with Legislator Fei Hung-Tai(費鴻泰) at Conference Room 103 of Chung-Sing Building(中興大樓) in Legislative Yuan. Union representatives and Legislator Fei will announce how the world biggest bank HSBC(滙豐銀行) and Sunny Bank(陽信銀行) violate Labor Union Law, depress labor rights, and exploit Taiwan Labors.

 

Furthermore, HSBC betrays the contract signed with Financial Supervisory Commission(金管會) and Central Deposit Insurance(中央存保), which will close 11 branches (ordinary Chinese Bank) by the end of this November after merging Chinese Bank for only 6 months. It will impact over 200 employees. Obviously, Government authorities, including Financial Supervisory Commission, Council of Labor Affairs and Department of Labor intend to cover up with no responses. 

 

The management of HSBC bans employees from joining the union. Also, the management applied internal regulations to restrict union representations from using internal internet network to deliver union messages and even gave union warning letters. Union assumes that HSBC behavior has viciously violate Taiwan Labors’ rights.

 

Democratic Progressive Party describes itself as Taiwan-Oriented. However, DPP forced employees of Sunny Bank to join DPP to voted DPP Legislator candidate Shui-Ling(薛凌). Sunny Bank Union faced huge depression from the management, including oral threatening and forcing to take job rotation.

 

HSBC and Sunny Bank management have violated the following law:

   Article 35 of Labor Union Law, “The employer or his agent shall not refuse to employ, dismiss, or give other unfair treatments to a worker by reason of his holding office in a labor union. Directors and supervisors of a labor union may request official leave of absence for the handing of union affairs. Standing directors may request such official leave of absence for half day or a full day to handle union affairs. The total period of such official leave for each director and supervisor shall not exceed 50 hours per month. Under special circumstances, the period of official leave of absence may be prescribed through negotiation between labor and management, or in the agreement.”

   Article 5 of Employment Service Act, “For the purpose of ensuring national’s equal opportunity in employment, Employer is prohibited from discriminating against any Job Applicant or Employee on the basis of race, class, language, thought, religion, political party, place of origin, place of birth, gender, gender orientation, age, marital status, appearance, facial features, disability, or past membership in any labor union.

   Article 14 of ROC Constitution, “The people shall have freedom of assembly and association.”

 

Taiwan government’s policy of Second Banking Reformation made people’s life worse. Government gave well-developed banks to syndicates, but left fraudulent banks to people. Take Chinese Bank as example, Finance Redeveloped Fund (金融重建基金)take tax-payers money, 474million dollars to foreign investors, which hoped that the foreign bank could input most updated information and management to re-develop the fraudulent bank. However, after merging Chinese Bank for only 6 months, HSBC announced that it will close up 11 branches, which located in low employment rate cities. This decision will affect over 200 employees. If any of those employees who cannot accept working rotation, he or she is required to voluntarily apply for employment contract termination.

 

What HSBC did have violated Central Deposit Insurance declaration that employees’ settlement plan of former Chinese Bank should be last for at least one year. As to this illegal action, we do not see any government authorities standing up for Taiwan labors.

 

The saddest mourn to Taiwan people is that government concerns about employers’ profits but not as much as their social responsibilities. Union appeals Taiwan government to make concrete actions to request foreign banks and realized the vision of “take advantage of but also give back to Taiwan”.
